Do you use infant formula?: Store Brand Baby Formula Wins a Final Round in Court

Store brand infant formulas have long been battling the name brands for recognition as being equal. Store brand formulas offer the same nutrients at the same levels as Enfamil, made by Mead Johnson.

In a case centered on PBM’s (a unit of Perrigo Co. that makes store brand infant formula) argument of equality, store brand infant formulas won a major victory this week when a U.S. Circuit Court upheld a $13.5 million false advertising claim against Enfamil maker Mead Johnson. The Court has stated that PBM can lawfully compare its products to national brand products. Bloomberg Businessweek offers more information about the lawsuit.

I have been following this lawsuit, curious about the turnout and rooting for PBM. You may ask yourself why a breastfeeding mother would care about a lawsuit centered around infant formula? Well that answer is simple. I used infant formula when we traveled and when I had to take antibiotics that weren’t safe while breastfeeding. I started out using the expensive formulas thinking they were better but quickly learned that they were WAY to expensive and the store brands had the same ingredients! There are MANY reasons a mother would choose to use infant formula versus breastfeeding and I will never condemn a mother for choosing to do so. And it is extremely nice to know that we can opt for the less expensive formulas and know our child is still receiving the nutrients they require.
